●恐怖の成年後見制度~誘拐された娘を母が取り戻す迄の６年間

私たち【裁判の可視化と公開を求める会】は、民事・刑事裁判公判のビデオ録画、場合によってはTV・ネットによるLIVE中継を文字通り「求めて」いる団体である。
だが、会を立ち上げる前にメンバーと話し合った結果、「離婚や子供の親権など個々の事情が持ち込まれる」家庭裁判所には立ち入らないようにするという方針を立てていた。が、裁判を調べていくと、腐敗から最も遠いと思っていた家庭裁判所が実は最も強烈な腐敗臭を漂わせていたのだった。
家庭裁判所で扱われる案件は「非訴事件」と呼ばれ、審理に傍聴人を入れない。だから書記官や事務官が裁判の当事者(つまり被告や原告)への脅迫、恫喝、そして記録の捏造が常態化しているのだ。
そして、多くの人たちは信じないだろうが、家裁によってある日突然「普通の人たち」の頭の上に理不尽な禍が降りかかってくる可能性がある。家裁が産み落とす禍の一つが「児童相談所による子供の連れ去り」問題。もう一つは、「成年後見制度」問題であった。
「成年後見人」の言葉だけは知っていても、どういう制度なのか詳しいことは誰も知らない。しかし、身内に成年後見人を付けられた人たちは残らず後悔し、そして苦しんでいるのだ。
その中でも、特段に酷い事例を最近知ることとなった。ある母と娘に恐ろしい災いが舞い降りてきたのである。「成年後見制度」という災いが┅。
知的障害と精神障害という二つの障害を持っていた娘に成年後見制度の中の補佐人(成年後見人よりも権限がやや低い役職)を付けられた女性がいた。その女性の娘は６年もの間、事実上“誘拐”されていた。
このブログで、母が娘を取り戻すまでの戦いを不定期ながら記させて頂きます。
ある日突然降りかかってきた「青年後見人」という厄災。この厄災の被害者をこれ以上生まない為には、そしてこの厄災にとり憑かれないようにするにはこの母娘にどんな災いが襲いかかり、どうやって戦ってきたかを知らせなければならないと確信した。
尚、母娘が体験したことをブログに掲載することの承諾は母娘からとっている。
勿論、登場する人物・団体は公的な存在以外は全て仮名とさせて頂きます。
