検察側は冒頭陳述で、「別のホームレスから瓶を足に投げつけられた少年が報復を決意し、他の３人に『火炎瓶を作るぞ』と指示した」と少年が主導的立場にあったことを指摘。「雨堤さんの住みかをそのホームレスの住みかと思い込んだ」としたうえで、「確実に殺害しようと、金網の出入り口に上半身を突っ込んだうえ、『出てこんか、こらぁ』と怒鳴りながら火炎瓶を投げ込んだ」と主張した。
一方、弁護側は「仲間の少年が『火炎瓶を作りましょうか』と話し、少年が同意した」と反論。さらに、少年は後頭部に（別のホームレスから）瓶をぶつけられたため、「ホームレスの住みかを燃やし、住めなくしてやろうと思った。（犯行前に）火のついた火炎瓶で金網の中を照らしたが、人の気配すら感じず、中に人がいるなど思ってもいなかった」と殺意を否認した。
